Welcome to BRAVE Ghana. These Terms of Service (“Terms”) govern your access to and use of the BRAVE Ghana mobile application, website, and all related services (collectively, the “Platform”), operated by BRAVE Ghana in partnership with the University of Cape Coast, Ghana (“we,” “our,” or “us”).
By creating an account, accessing, or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform.
Important Notice
BRAVE Ghana is not an emergency or crisis service. If you are in immediate danger or experiencing a mental health crisis, please contact your local emergency services immediately. In Ghana, call 112 (National Emergency Number) or the Ghana Health Service helpline.
1. Eligibility
You must be at least 13 years of age to use the Platform. If you are under 18 years of age, you represent that a parent or legal guardian has consented to your use of the Platform and these Terms. We reserve the right to request proof of parental or guardian consent at any time.
2. Account Registration and Security
To access most features of the Platform, you must create an account. You agree to:
- •Provide accurate, current, and complete information during registration.
- •Maintain and promptly update your information to keep it accurate.
- •Maintain the security and confidentiality of your login credentials.
- •Notify us immediately of any unauthorised use of your account.
- •Accept responsibility for all activities that occur under your account.
We reserve the right to suspend or terminate accounts that contain false or misleading information, or that violate these Terms.
3. Platform Services
BRAVE Ghana provides the following core services:
- •Mental Health Assessments: Validated psychological screening tools (PHQ-9, GAD-7) to help you understand your wellbeing. These are screening tools, not clinical diagnoses.
- •Bullying Reporting: A secure system for reporting bullying incidents, whether you are a victim, witness, or offender seeking help. Reports may be submitted anonymously.
- •AI Wellness Assistant: An artificial intelligence-powered conversational tool that provides general wellness guidance and emotional support.
- •Expert Consultations: Access to licensed mental health professionals for scheduled consultations through the Platform.
- •Mood Tracking: Daily mood logging and longitudinal wellness analytics to help you recognise patterns in your emotional wellbeing.
- •Breathing Exercises: Guided breathing and relaxation exercises grounded in evidence-based techniques.
4. Acceptable Use Policy
You agree to use the Platform responsibly and in accordance with all applicable laws. You must not:
- •Use the Platform to harass, threaten, intimidate, or bully any person.
- •Submit false, fabricated, or malicious bullying reports.
- •Impersonate any person or misrepresent your identity or affiliation.
- •Attempt to gain unauthorised access to other users' accounts, data, or Platform infrastructure.
- •Use automated tools, bots, scrapers, or other means to access the Platform without authorisation.
- •Upload or transmit viruses, malware, or other harmful code.
- •Use the Platform for any commercial purpose or to advertise products or services.
- •Attempt to reverse-engineer, decompile, or disassemble any part of the Platform.
- •Interfere with the proper functioning of the Platform or disrupt other users' experience.
Violation of this policy may result in immediate suspension or permanent termination of your account.
5. Intellectual Property
All content, design, features, code, trademarks, logos, and other intellectual property on the Platform are owned by or licensed to BRAVE Ghana and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Platform content without our prior written consent.
By submitting content through the Platform (such as bullying reports, mood entries, or chat messages), you grant BRAVE Ghana a non-exclusive, royalty-free licence to use, process, and store such content solely for the purpose of operating and improving the Platform and conducting anonymised research.
6. Expert Services
Mental health professionals available through the Platform are independent, licensed practitioners. While we verify their credentials before granting access to the Platform:
- •BRAVE Ghana does not employ these experts and is not responsible for the clinical advice, opinions, or recommendations they provide.
- •Expert consultations through the Platform do not establish a formal therapist–patient relationship unless explicitly agreed upon with the specific expert.
- •For ongoing treatment, experts may recommend in-person consultations or referrals to appropriate healthcare facilities.
7. AI Wellness Assistant Disclaimer
Our AI-powered wellness assistant is designed to provide general wellness information, emotional support, and coping strategies. It is not a substitute for professional medical advice, diagnosis, or treatment. The AI assistant:
- •Does not and cannot provide clinical diagnoses.
- •May occasionally produce responses that are inaccurate, incomplete, or not applicable to your specific situation.
- •Should not be relied upon as the sole basis for making decisions about your mental health or wellbeing.
- •Is not a crisis intervention tool and cannot respond to emergencies.
Always consult a qualified mental health professional for specific medical or psychological concerns.
8. Privacy
Your privacy is fundamentally important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the practices described in our Privacy Policy.
9. Disclaimers and Limitation of Liability
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
To the maximum extent permitted by Ghanaian law, BRAVE Ghana expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- •The Platform will be uninterrupted, error-free, or available at all times.
- •Results obtained from assessments or the AI assistant will be accurate or reliable for clinical purposes.
- •The Platform will meet all of your specific expectations or requirements.
To the maximum extent permitted by law, BRAVE Ghana shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or damages arising from your reliance on the Platform, its content, or any services provided through it.
10. Indemnification
You agree to indemnify, defend, and hold harmless BRAVE Ghana, the University of Cape Coast, and their respective officers, directors, employees, agents, and partners from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from or related to your use of the Platform, your violation of these Terms, or your violation of any rights of another person or entity.
11. Modifications to These Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via in-app notification or email to your registered address at least 14 days before they take effect. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must discontinue use of the Platform and delete your account.
12. Termination
You may delete your account at any time through the Platform's settings. We reserve the right to suspend or terminate your account without prior notice if:
- •You violate any provision of these Terms or the Acceptable Use Policy.
- •We are required to do so by law or a court order.
- •Your account activity poses a risk to the safety or security of other users.
- •We discontinue or materially modify the Platform.
Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) shall survive.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of Ghana. Any dispute arising out of or in connection with these Terms shall first be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to mediation or arbitration in accordance with the Alternative Dispute Resolution Act, 2010 (Act 798) of Ghana, before resorting to the courts. The courts of the Republic of Ghana shall have exclusive jurisdiction over any legal proceedings.
14. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and BRAVE Ghana regarding your use of the Platform and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.
